Any access to and use of this website (“this Website”) is governed by the terms and conditions of use set out below, which incorporate our terms of sale (collectively referred to as our “Terms and Conditions”). Use of this Website implies your agreement and acceptance of these Terms and Conditions. PLEASE ENSURE YOU HAVE READ AND UNDERSTAND THESE TERMS AND CONDITIONS. Chess Cubs and the User shall collectively be referred to as “the Parties”.
1. DEFINITIONS
1.1 “Coach” means a chess coach who is registered with this Website as an independent contractor to provide the Services to the Member.
1.2 “Content” means all text, articles, scripts, personal or professional information, information, documents, graphics, digital files, photographs, mobile content, sounds, music, audios, or audio-visual files, videos, and interactive features and any other form of information capable of being stored on a computer that appears on, or forms part of this Website.
1.3 “Intellectual Property Rights” or “IPRs” mean any copyright or rights of a similar nature, unregistered and registered trade marks, service marks, unregistered and registered designs including the right to register any such rights.
1.4 “Media” means any and all multi-media channels, videos, photographs, animations, sound and music contained on this Website.
1.5 “Member” means a User that chooses to Subscribe to the Services or, where that User is under the permitted age to subscribe to the Services in their jurisdiction, the responsible adult for that User.
1.6 “Membership fee” means the annual registration fee (where applicable) payable by the User to become a Member
1.7 “Privacy Policy” means the privacy policy found at https://chesscubs.co.uk/privacy-policy/.
1.8 “Services” means the Services set out in Clause 2.1 below.
1.9 “Subscribe” means registration by payment of any Membership fees and then payment of the Subscription fee by a User to become a Member.
1.10 “Subscription fee” means the monthly subscription fee payable by the Member for access to the Services on a weekly basis.
1.11 “User”, “you” or “your” means a prospective member that is able to access and browse the Content on this Website.
1.12 “Website” means the website. www.chesscubs.co.uk.
2. HOW THIS WEBSITE WORKS
2.1 The Website facilitates the User who wishes to become a Member and use the Services as provided by a Coach, namely chess tuition services, through this Website from time to time and as described in these Terms and Conditions. If the use of this Website is as a result of an agreement between a third party and Chess Cubs, then to the extent that these Terms and Conditions conflict with the terms and conditions of such an agreement, the Terms and Conditions of this Website shall prevail. If the User does not agree with the applicable Terms and Conditions, then the User is not authorised to use this Website.
2.2 The User enters the Website and selects one of the available options found on the option page https://chesscubs.co.uk/#fees. The User then registers for one of the available options for a free trial (whilst available) or to become a Member and is directed to the payment options as applicable.
2.3 Chess Cubs reserve the right to change these Terms and Conditions at any time without notice by updating this page of this Website. Use of this Website after the Terms and Conditions have been updated constitutes acceptance of the Terms and Conditions as updated.
2.4 This Website and all Intellectual Property Rights contained therein are the property of Chess Cubs save in respect of the Intellectual Property Rights belonging to any licensor, advertisers, partners, investors or sponsors of this Website.
2.5 This Website is accessible from various parts of the world and, subject to laws in the jurisdictions where this Website is accessed, the Services provided through this Website are available to Users in that jurisdiction.

3. USE OF WEBSITE BY THE MEMBER AND/OR USER
3.1 This Website constitutes an invitation to treat. By using this Website, the User accepts these Terms and Conditions, as well as the terms of Chess Cubs’ Privacy Policy.
3.2 In order to use the Services on this Website, the User must Subscribe to this Website and become a Member, in order for the Member to be assigned a Coach. Chess Cubs facilitate the connection between the Coach and the Member. This Website will guide you through the process of becoming a Member and using the Services.
3.3 Chess Cubs makes all reasonable efforts to ensure that all prices shown on this Website are correct at the time of going online. Chess Cubs reserves the right to change prices and to add, alter, or remove special offers from time to time and as necessary.
3.4 If Chess Cubs, for any reason, is unable to grant you subscription, no payment shall be taken under normal circumstances. If payment has been taken any such sums will be refunded to you as soon as possible and in any event within 7 working days.
3.5 Cancellation of the Services can only be effected no less than 48 hours before a weekly session. Once a Coach has started providing the Services, or within 48 hours of a scheduled session, no cancellation will be permitted.
3.6 Chess Cubs accepts various payment methods as shown on this Website from time to time.
3.7 Chess Cubs is always striving to provide an exceptional service to its Members. This is often helped by recording sessions for training and quality assurance purposes. From time to time Chess Cubs also promotes its services by showcasing clips of Members using the Services. When subscribing the Member shall be given the options to (i) opt in to having sessions recorded, and (ii) opt in to having clips from those recording used in promotional materials.
3.8 Whilst Chess Cubs makes every effort to vet the Coaches providing the Services and takes safeguarding seriously, Chess Cubs takes no responsibility for the acts or omissions of Coaches. To see more on our safeguarding policy, please click here.
3.9 Chess Cubs intends to provide a range of other services, details of which can be found on this Website from time to time.
3.10 The use of this Website by the User is free of charge, subject to these Terms and Conditions.
3.11 It is the User’s responsibility to make any and all arrangements necessary in order to access this Website.
4. MEMBER AND USER OBLIGATIONS
4.1 Each User using this Website acknowledges that, save for the details required at the point of subscribing to become a Member, he/she will not be required to provide Chess Cubs with any personal or personal sensitive information. The Member and/or User will never be asked by Chess Cubs to provide information such as banking details, PIN numbers or sensitive medical information.
4.2 The Member and/or User agrees warrants and undertakes that the Member and/or User will not use the Services to request products or services that the Member and/or User already offers (making the Member and/or User a potential competitor to Chess Cubs). This will be treated as an abuse of this Website and the Services and Chess Cubs reserve the right to take appropriate action to stop such abuse.
4.3 The Member and/or User agrees and warrants that he or she will provide continued agreement to the Terms and Conditions whilst using this Website and the Services.
4.4 The Member warrants that their subscription is for their use only and is non-transferrable.
4.5 The Member and/or User agrees to indemnify and keep fully indemnified Chess Cubs against any and all loss or damage of any kind suffered as a result of the Member and/or User’s misuse of the Services and/or this Website or any breach or non-observance of these Terms and Conditions.
5. CHESS CUBS’ OBLIGATIONS
5.1 Chess Cubs is responsible for providing the Services to the User with care and professionalism.
5.2 For the avoidance of doubt, Chess Cubs shall have the right to withhold or suspend the Services as it deems reasonably appropriate, and without any liability to the User or Member in the event of:-
5.2.1 Abuse of the Website;
5.2.2 Recording of the provision of the Services (whether audio or audio visual recording);
5.2.3 Harassment of Coaches;
5.2.4 Abuse toward staff of Chess Cubs; and
5.2.5 Non-payment of Membership or Subscription fees.
This list is non-exhaustive.
5.3 Any changes to these Terms and Conditions shall be communicated to the User in accordance with clause 2.3 above.
5.4 Chess Cubs shall endeavour to establish and maintain reasonable safeguards against the destruction, loss or unauthorised alteration of this Website and shall institute security procedures to restrict unauthorised access to this Website, data and data files, including any back up material. This is a secure website with SSL certificate.
6. WEBSITE CONTENTS, FUNCTIONALITY AND WARRANTIES
6.1 Chess Cubs shall not be under any duty to place information on this Website, nor to update or correct any such information. Chess Cubs may in its absolute discretion edit, amend or remove any information placed on this Website at any time and without notice, including the appearance, style, look and feel, Content and functionality of this Website. For the avoidance of doubt, Chess Cubs shall be under no obligation to add or update details of Coaches.
6.2 Chess Cubs does not warrant or offer any assurances that this Website is compatible with a User or Member’s computer equipment or the network through which the User or Member accesses this Website.
6.3 Whilst Chess Cubs shall use its reasonable endeavours to ensure that this Website is functioning at all material times, it does not warrant that this Website will be fully functional at all times.
6.4 Whilst Chess Cubs intends to display accurate information on this Website, it neither makes nor gives any representations or warranties, express or implied, about this Website or any material, information or hypertext links on this Website, including, but not limited to accuracy, completeness, legality, suitability for purpose, functionality, reliability, availability, speed of access or timeliness.
6.5 Whilst it is the intention of Chess Cubs to provide Members with access to Coaches of a high standard, it neither makes nor gives any representations or warranties, express or implied, about the availability or quality of the Services. Chess Cubs acts as a portal for Members to obtain chess tuition from Coaches and therefore does not accept any liability whatsoever for any acts or omissions of any third party and furthermore, Chess Cubs shall not be held responsible in anyway whatsoever for the performance and/or conduct of any third party, including Coaches. The User further agrees that the continuing use of this Website and the Services by the User amounts to acceptance and agreement of this Clause 6.5.
6.6 This Website may provide links to other third party sites on the Internet from time to time. These sites may contain information or material that some people may find inappropriate, offensive or irrelevant. These third party sites are not under the control of Chess Cubs, and by continuing to use this Website you acknowledge that Chess Cubs are not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such sites. The inclusion of such a link does not imply endorsement of the site by Chess Cubs or any association with Chess Cubs.
6.7 If sections of this Website contain information submitted to Chess Cubs by third parties, Chess Cubs shall not be held liable for any error, omission or inaccuracy in such material or submissions and reserve the right at Chess Cubs’ absolute discretion to omit, suspend or change any material or information submitted without giving notice.
6.8 Chess Cubs shall exercise all reasonable skill and care to ensure that this Website is secure and free from viruses and other malware.
6.9 The Member and/or User is responsible for protecting their hardware, software, data and other material from viruses, malware, and other internet security risks.
7. LIMITATION OF LIABILITY
7.1 Nothing in these Terms and Conditions shall exclude or in any way limit Chess Cubs’ liability for fraud, (or for death or personal injury caused by its negligence), or any other liability to the extent such liability may not be excluded or limited as a matter of law. Subject to this clause 7.1:
7.1.1 Chess Cubs shall have no further liability to the User or Member in respect of the Services, whether in contract, tort (including negligence) or otherwise; and
7.1.2 Chess Cubs shall not be liable to the User or Member in respect of the Services for any loss of actual or anticipated income or profits, loss of contracts or for any special, indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise, whether or not such loss or damage is foreseeable, foreseen or known.
8. CANCELLATION & TERMINATION
8.1 Where a User ceases to use this Website the User will not be required to notify Chess Cubs.
8.2 A Member has a legal right to a “cooling off” period within which he/she can cancel their subscription for any reason. This period begins once payment for the subscription is accepted and the Member receives confirmation. The period ends at the end of 14 calendar days after that date.
8.3 Chess Cubs reserves the right to terminate the subscription and membership of a Member, without any liability for any reasons set out in clause 5.2 above.
9. DATA PROTECTION
9.1 The use of the Members’ information is governed by our Privacy Policy, which is incorporated into these Terms and Conditions by this reference.
9.2 Cookies are used on this Website as set out in our Privacy Policy.
10. ENTIRE AGREEMENT AND SEVERABILITY
10.1 These Terms and Conditions constitute the entire understanding between the Parties with respect to the subject matter of this Website and supersede all prior terms and agreements between the parties relating to it.
10.2 If any clause(s) of these Terms and Conditions is held invalid or unenforceable, the clause shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the Parties, and the remaining clauses shall remain in full force and effect.
11. NOTICES
11.1 Any notice to be served under these Terms and Conditions shall be in writing and served upon the other Party at its address (in the case of Chess Cubs as set out above) either by hand or by first class pre-paid post and shall be deemed served 48 hours after posting if sent by post, or on delivery if delivered by hand. The Parties accept service by e-mail using the e-mail set out above for Chess Cubs and the email provided by the Member at registration.
12. LAW AND JURISDICTION
12.1 These Terms and Conditions shall be governed by the law of England and Wales and the Parties hereto submit to the exclusive jurisdiction of the English courts.
13. ACCEPTANCE
13.1 Use of this Website by the User implies agreement and acceptance of these Terms and Conditions. Date last updated: 18 November, 2021.
Terms and Conditions for Workshop Wednesdays
1.Eligibility:
Workshop Wednesdays are available at a subsidized price exclusively for children aged 7 -10, who (1) know the basic rules of chess; (2) how to move the pieces, and (3) how to play a simple game. (i.e. Chess Cubs Adventurer ability level) Participants must meet these eligibility criteria to enroll in the workshop.
2. Registration and Payment:
– Registration for the workshop is confirmed upon receipt of full payment of the subsidized fee.
– Payment must be made in advance to secure a place in the workshop.
3. Workshop Content:
– The workshop will cover a series of topics appropriate to the Chess Cubs Adventurer ability level including
tactics development, opening best practice and developing board vision.
– Participants are expected to attend all sessions to fully benefit from the workshop.
4. Cancellation and Refunds:
– Cancellations are not eligible for refund.
– Participants may request a transfer of their registration to another eligible individual with prior notice and approval from the organizers.
5. Changes and Cancellations by Organizers:
– The organizers reserve the right to cancel or reschedule the workshop due to unforeseen circumstances or if minimum enrollment requirements are not met.
– In such cases, participants will be notified promptly, and alternative arrangements or a full refund will be offered.
6. Conduct and Participation:
– Participants are expected to conduct themselves respectfully towards instructors and fellow participants.
– Disruptive behavior may result in removal from the workshop without refund.
7. Liability
– The organizers are not liable for any loss, damage, or injury sustained by participants during the workshop.
8. Photography and Recording:
– Photography, audio, or video recording of the workshop sessions is prohibited without prior permission from the organizers.
9. Data Protection:
– Personal information collected during registration will be used solely for workshop administration and communication purposes in accordance with applicable data protection laws.
10. Agreement to Terms:
– By registering for the workshop, participants acknowledge and agree to abide by these terms and conditions.
11. Affiliation
Workshop Wednesdays are sponsored by the book-ends shop, who are affiliated with Chess Cubs.
These terms and conditions are subject to change at the discretion of the organizers. Participants will be notified of any amendments.
